Terms of Service & Acceptable Use Policy


The following terms and conditions apply to all accounts provided, managed or serviced by PTNS Enterprises Limited.

PTNS Enterprises Limited agrees to provide the client web hosting and or website management services for a monthly/annual fee.

PTNS Enterprises Limited will endeavour to ensure that all client queries are dealt with in a timely manner.

PTNS Enterprises Limited does not and will not require clients to advertise for or on behalf of PTNS Enterprises Limited on their website in any way shape or form unless a formal agreement is arranged as a result of preferential treatment being provided - such as in the provision of services for a non-profit organization.

Clients may utilise our service for personal, business or commercial use.

Site Content
The services provided by PTNS Enterprises Limited are to be used for lawful purposes only.

The presentation, storage or provision of access to information, data or material that violates United Kingdom or International law is prohibited. This includes, but is not limited to:

  • Copyrighted material
  • Trademarked material
  • Material/Information protected by trade secrets and other statute




In addition the services provided by PTNS Enterprises Ltd shall not be used for the provision of the following material:

  • pornographic or adult oriented materials
  • links to pornographic or adult oriented materials
  • Pirated software or links to such materials.
  • hackers programs, archives or links to such materials.
  • Warez sites or links to such materials.
  • content that may be considered prejudicial or abusive to an individuals Race, Creed or Color
  • Spamming facilities or materials
  • MP3 or DVD/Video files
  • Email lists or bulk email software










The client agrees to indemnify and hold harmless PTNS Enterprises Limited from any claims resulting from the use of the service which damages the client or any other party.

It is the clients responsibility to ensure that the services provided by PTNS Enterprises Limited to the client are used in a lawful manner.  The client agrees to idemnify and hold harmless PTNS Enterprises Limited from any claims and or actions arising as a result of the client using the services provided by PTNS Enterprises Limited in an unlawful manner.

Controlled/Banned Applications and Scripts
Clients are free to use a wide variety of applications or scripts provided they do not interfere with the provision of our normal service or those of our other clients. 

Clients may not however operate or install the following applications or scripts without the prior authority of PTNS Enterprises Ltd.  

  • Background-running programs - such as IRC related software, bouncers and bots, etc
  • Chat Rooms
  • Formail - there are many other scripts that fulfil this function without the security issues
  • CGI based Forums and banner exchanges





In certain cases we may allow programs to run in the background, such instances will be considered on a one to one basis and an extra charge will be incurred based on the system resources used and any operational configuration/maintenance required.

In the event a script affects normal server and/or administrative operations, PTNS Enterprises Limited reserves the right to disable the account pending client cooperation - should such cooperation not be forthcoming the account will be terminated. 
Security
Clients may not use the services provided by PTNS Enterprises Limited for illegal practices or with the explicit intention of breaching the security controls/systems of PTNS Enterprises Limited or any other service provider.

Clients will be held directly responsible for any security breach caused by their actions or by the use of any application/script used by the client, whether intended or otherwise.  Furthermore Clients accept full responsibility for the actions of their own client/customer/member base and any security violations resulting from their actions.

Clients are not permitted to:
 
  • access data to which they have not been authorized to access.
  • enagage in Password cracking
  • probe or attempt to probe the security of another website or other networks
  • interfere or deny service to any user, host, or network.
  • engage in or facilitate deliberate attempts to overload or crash another client, host or network






PTNS Enterprises Limited will cooperate fully with any investigation arising as a result of a security violation of any computer, server, system or network - including cooperating with law enforcement agencies in the investigation of suspected criminal activities. 

Clients who violate our own or another providers system or network security will have all PTNS Enterprises Ltd services withdrawn immediately without recourse to a refund and may be subject too criminal or civil liability.
Backups
Clients are responsible for the backup of their own data.  PTNS Enterprises Limited advises clients to back up their website and related data regularly for their own protection.  Clients must be aware of the importance of their own data and where necessary ensure the level of importance they place upon backups/data recovery is reflected in their own "backup" systems.

PTNS Enterprises Limited does not provide a client 'backup' service unless the website management option is purchased.  If the website management option is purchased PTNS Enterprises will take reasonable measures to "Backup" the clients data and endeavour to ensure that these "backups" are available to the client should they be required. 

PTNS Enterprises Limited accepts no responsibility for any loss of data or consequence arising from the failure of a client to 'Backup" or make provision for the loss of data held.

PTNS Enterprises Limited makes no guarantee that any "Backup" created, whether by the client or PTNS Enterprise Limited will be fit for purpose or that such a "Backup" will contain the data required by the client to rebuild their website, database, etc. 
Service Provision
PTNS Enterprises Limited will endeavour to ensure that the services provided are constantly available.

PTNS Enterprises Limited reserves the right at its sole discretion to refuse/cancel all or any individual service.

PTNS Enterprises Limited purchases server space from a range of suppliers to ensure the best value for money for its customers.  Clients understand and recognise therefore that the services provided by PTNS Enterprises Limited are dependant upon the services and facilities provided to PTNS Enterprises Limited.  Should a service become unavailable due to a shortfall or failure in the service provision to PTNS Enterprises Limited clients are aware that this could take up to 10 days to rectify.  PTNS Enterprises Limited will endeavour to ensure that any such service shortfall is rectified and replaced if necessary, in the fastest possible manner subject to reasonable cost.
Refunds
Clents that cancel their accounts at any time up to 48hrs prior to their billing date will not be billed for the following month.

Clients that pay annually for web site hosting services will be issued a pro-rata refund for months not used. 

Domain registration, website design and setup fees where incurred are non-refundable, in whole or in part.

PTNS Enterprises Limited offers no kind of "money back" guarantee and reserves the right to provide any form of refund at its own discretion.

Should a service failure occur PTNS Enterprises Limited reserves the right to determine the level of compensation if any that it will provide its clients.  Clients agree that the maximum refund will be the amount paid for the service over the period of the failure, which will be credited to the clients account.  No refund will be payable unless the failure exceeds a 72hr period. 

Accounts terminated due to policy violations will not be refunded.

Disclaimer
PTNS Enterprises Limited will not be responsible for any damages that you as an individual or your business may suffer as a result of using the services provided by PTNS Enterprises Limited.

PTNS Enterprises Limited makes no guarantee or provides any warranty of any kind, expressed or implied in relation to the services provided.  This includes the loss of data resulting from server failures, script/application failures, power outages, delays and all service interruptions caused by PTNS Enterprises Limited and or its employees and service providers. 

PTNS Enterprises Limited makes no "uptime" guarantees. 
Privacy
All communications; verbal, written or electronic (email or otherwise), are between PTNS Enterprises Limited and the client. These communications are private and are therefore not to be shared with any other parties
Liability
Clients agree to indemnify PTNS Enterprises Limited against any and all court action resulting from the clients activities that result in the violation of any law or this policy, the client agrees to pay any damages awarded or fines imposed against PTNS Enterprises Limited, plus costs, reasonable legal fees and reimbursement for any loss of income. 

 Violation of any of PTNS Enterprises Limited's Terms and Conditions may result in a warning, suspension, or account termination at the discretion of PTNS Enterprises Limited. 

PTNS Enterprises Limited will endeavour to inform all clients of any and all updates made to this policy.  However PTNS Enterprises Limited reserves the right to alter, edit, or update the policies contained in this document at any time without notice.
